We kindly inform you that the Administrator of your personal data (ADO) obtained in connection with your contact is Pekao Faktoring Sp. z o.o. with its registered office in Lublin 20-076, Krakowskie Przedmieście Street 64. The ADO assigns a person responsible for ensuring compliance with the law on personal data protection, who can be contacted at e-mail address: daneosobowe@pekaofaktoring.com.pl.

The ADO informs that it will process your personal data, including your name, surname, telephone number, e-mail address and other data disclosed by you, in order to respond to your query, including, when you express such a will, to provide information about the current offer of Pekao Faktoring Sp. z o.o.. The legal basis for the processing of your personal data is the legitimate interest of the Administrator in the form of realization of contact with a client/contractor or potential client/contractor. In accordance with the wording of the Act on the provision of services by electronic means and the Telecommunications Act, if you wish to obtain information about the Administrator’s offer by e-mail or in a telephone conversation, the provision of such information is possible only with your consent, whereby the submission of an inquiry about an offer by e-mail or in a telephone conversation is understood by the Administrator as consent to send it through the same channel by which the inquiry was submitted.

The Administrator also informs you that in the concern for security and the highest quality of services provided, telephone calls are recorded. In this case, the Administrator will also process your personal data for the reason of establishing, investigating or defending against possible claims concerning the conversation and its content – based on the Administrator’s legitimate interest in establishing, investigating or defending against claims. Due to the wording of the Telecommunications Law, recording of the conversation is possible with your consent. If you do not consent to call recording, please use another communication channel (e.g. e-mail).

Submission of personal data is voluntary. ADO shall process your data for the period necessary to respond, and thereafter for the period necessary to secure possible claims, as provided by law. ADO hereby also informs you that no decisions will be made on the basis of your personal data in an automated manner, and they will not be sold or shared with external entities, except for the entities and circumstances of their disclosure provided by law.

ADO informs you that you have the right to access, rectify, erase or restrict the processing of your data, the right to object to the processing of your data and to lodge a complaint with a supervisory authority, as well as the right to data portability. ADO also informs you that you have the right to withdraw your consent at any time, and that withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

Information clause on personal data processing for Factorees and potential clients of Pekao Faktoring

The administrator of the personal data is Pekao Faktoring Sp. z o.o., based in Lublin, 64 Krakowskie Przedmieście St. The administrator informs that:

The purpose of data processing is to conclude and perform the agreement between the Administrator and the Factoree and, for this purpose, to carry out risk assessment and monitoring of the factoring transaction; to fulfill the Administrator’s obligations under the law, as well as to realize the Administrator’s legitimate interests, consisting, in particular, of the possibility to assert, protect and secure claims; to prevent fraud and economic crimes and direct marketing.

The basis for the processing of personal data is: legal regulations, including anti-money laundering and counter-terrorist financing regulations and tax and accounting regulations; as well as the realization of the Administrator’s legitimate interests, consisting, in particular, of the possibility of asserting, protecting and securing claims, as well as preventing fraud and economic crimes and direct marketing.

The Administrator processes the following categories of personal data: name, surname, contact data, identification data. The source of personal data is the Factoree indicated in the Notification of Contract between the Administrator and the Factoree.

Personal data processed by the Administrator may be made available to Recipients of personal data, which may be Bank Pekao S.A., business information bureaus, law firms, auditing companies, insurance providers who insure the Administrator’s factoring activities, companies assisting the Administrator in the enforcement of claims, IT service providers, archiving companies, postal operators and companies handling correspondence, as well as the General Inspector of Financial Information and the National Bank of Poland.

Personal data will be processed for the period necessary for the purposes of processing indicated above, in particular, in terms of the execution of the agreement concluded between the Administrator and the Factoree until its completion, and then in the legitimate interest for securing possible claims or until the expiration of the obligation to store data under the law. You have the right to access your data and the right to rectify, delete or restrict its processing, as well as the right to data portability and the right to object. In addition, you have the right to lodge a complaint with the supervisory authority dealing with personal data protection.
